FAQ

Why Does Legal Vocabulary Differ More Between Taiwan and China?

The twenty-five terms below are mostly script-only differences, because they describe legal concepts common to both systems — evidence, a defendant, a verdict. The real gaps appear one level down, in institution-specific terms with no shared concept to translate, since the institutions themselves differ:

國民guómín法官fǎguān国民guómín法官fǎguān (Taiwan’s citizen judge, sitting alongside professional judges) vs. 人民rénmín陪審員péishěnyuán人民rénmín陪审员péishěnyuán (China’s people’s assessor) — two different lay-participation systems, two unrelated terms.

地方dìfāng法院fǎyuàn地方dìfāng法院fǎyuàn (Taiwan’s district court) vs. 基層jīcéng人民rénmín法院fǎyuàn基层jīcéng人民rénmín法院fǎyuàn (China’s grassroots people’s court) — the lowest-level trial court in each system, named on entirely different logic.

地檢署dìjiǎnshǔ地检署dìjiǎnshǔ (Taiwan’s district prosecutors’ office) vs. 人民rénmín檢察院jiǎncháyuàn人民rénmín检察院jiǎncháyuàn (China’s people’s procuratorate) — both house the prosecutors from section 02 below, but the institution wrapping them has no shared name.

Legal vocabulary varies somewhat between Taiwan and Mainland China’s legal systems as well as script — the terms above reflect general usage common to both. If you found this useful, related territory worth covering next includes contract vocabulary (甲方jiǎfāng甲方jiǎfāng, 乙方yǐfāng乙方yǐfāng, 違約wéiyuē违约wéiyuē, 賠償péicháng赔偿péicháng), labor law vocabulary (勞基法láojīfǎ劳基法láojīfǎ, 資遣zīqiǎn资遣zīqiǎn, 加班費jiābānfèi加班费jiābānfèi) — a natural companion to workplace-culture topics — and intellectual property vocabulary (專利zhuānlì专利zhuānlì, 商標shāngbiāo商标shāngbiāo, 著作權zhùzuòquán著作权zhùzuòquán) for readers coming from tech and engineering backgrounds.
