FAQ

Why Does Labor Law Vocabulary Diverge So Much Between Taiwan and China?

More than in contract or IP vocabulary, where usually one flagship term splits, labor law has several genuine word-choice divergences below — minimum wage, layoff, severance, and pension all use different words, not just different scripts. That’s because both sides built their welfare-state vocabulary independently after 1949, each tied to its own social insurance system: Taiwan’s 勞保láobǎo劳保láobǎo (labor insurance) and China’s 社會shèhuì保險bǎoxiǎn社会shèhuì保险bǎoxiǎn (social insurance) grew up as separate systems, so the terms describing them never had a shared origin to converge from.

New employees all must sign a labor contract.

Taiwan says 勞動láodòng契約qìyuē劳动láodòng契约qìyuē or the more casual 勞動láodòng合約héyuē劳动láodòng合约héyuē in everyday speech; mainland China standardized on 勞動láodòng合同hétong劳动láodòng合同hétong — the term used in China’s Labor Contract Law. A genuine word split, following the same pattern as 合約héyuē合约héyuē vs. 合同hétong合同hétong for “contract” generally.

Taiwan calls it 基本jīběn工資gōngzī基本jīběn工资gōngzī (“basic wage”); China calls it 最低zuìdī工資gōngzī最低zuìdī工资gōngzī (“lowest wage”) — same concept, genuinely different name.

Extended Reading

Labor law shares a lot of DNA with contract vocabulary, since an employment agreement is a contract, and with legal vocabulary for anything that escalates to a dispute. If you manage a team across the strait, intellectual property vocabulary rounds out the set for anything involving invention assignment or confidentiality clauses in an employment contract.
